Trademark status and its meanings

Tracking the status of a trademark application is straightforward with the government’s online portal. However, understanding each status is crucial to accurately interpret the progress of your application. Here’s what each trademark status signifies:

1. Formalities Check Pass:

Your trademark application has been filed correctly without any errors.

2. Formalities Check Fail:

There is an error in your application, which may require corrections. An amendment form (TM-F) may need to be filed to rectify the mistake.

3. Send to Vienna Codification:

If your application includes a logo, it is classified according to the Vienna Codification system.

4. Marked for Exam:

Your application is under examination by a Trademark Examiner.

5. Awaiting Reply to Examination Report:

If objections are raised under Section 9 or Section 11 of the Trade Marks Act, you must file a response to the examination report.

6. Objected:

Your application has been objected to by the Trademark Registry, and a reply to the examination report has been submitted.

7. Exam Report Issued:

The Examiner has issued a report that may accept your application or raise further queries.

8. Ready for Show Cause Hearing:

Your application is scheduled for a hearing to address any issues before proceeding.

9. Abandoned:

The application is considered abandoned if a response is not filed within the given timeframe.

10. Advertised Before Acceptance (Advertised bef acc):

The application is published in the Trademark Journal but is open to third-party opposition before final acceptance.

11. Accepted & Advertised:

Your trademark has been published in the Trademark Journal along with user evidence.

12. Opposed:

A third party has filed an opposition against your trademark application.

13. Registered:

Your trademark has been successfully registered.

14. Refused:

The application has been refused by the department, possibly due to non-receipt of fees or other reasons.

15. Withdrawn:

The applicant has voluntarily withdrawn the trademark application.

16. Send Back to EDP:

The application has been returned for proper data entry or digitization.

17. Send to PRAS:

The application has been sent to the Pre-Registration Amendment Section (PRAS) for processing any filed amendments.

18. Rectification Filed:

A third party has filed a rectification application to remove your trademark from the register.

19. Accepted:

Your trademark has been accepted but is awaiting publication in the Journal.

20. Cancelled:

The application has been cancelled, which could occur for various reasons, including non-compliance with legal requirements.
